The following is an brief outline of our Terms and Conditions. We advice all potential buyers to read this thoroughly, as it deals with many questions that buyers might have.

Skay LTD Online Conditions of Use

  1. Trading with Skay LTD requires that the client agree to the conditions of use written in this document. It is to be considered a contract between the company and the client.

  2. Skay LTD reserves the right to change the terms within the Conditions of Use. Skay LTD will give clients notice through the website and will be given a period of time to withdraw from the contract in the event of any changes.

  3. Membership through the creation of an account with complete details is required before any trade can be made through the website. Creating an account is free, and clients will only be required to pay when they make a request for a vehicle.

  4. Skay LTD reserves the right to refuse a purchase or auction order at its discretion.

  5. Deposits for purchasing vehicles are refundable if a vehicle has not been purchased. However, if fees and costs have been incurred during the process of purchase, these fees will be deducted from the deposit. Deposits are required for proxy bids, which is a certain percentage of the cost of the vehicle and the commission for bidding.

  6. Clients can ask to cancel their proxy bids until the day before the auction, and any deposits will be refunded. Skay LTD will do its best to cancel when asked at the day of the auction, but it cannot be guaranteed, and if a car has been purchased due to a late cancellation, the client will be charged for the vehicle.

  7. Skay LTD does not inspect auction vehicles prior to bidding, and any information pertaining to the vehicle will only be available from the related auction house websites. Skay LTD does not provide translations for Vehicle Auction Descriptions, but we will give advice via electronic mail about for any notable details about a vehicle that a client has placed a proxy bid order for. Any information given will be acquired through the translation of vehicle details through the auction websites.

  8. Skay LTD can give advice about vehicles to interested clients, but consultation can only be given to customers that have already placed a clear investment in the purchase of a vehicle.

  9. Vehicles will be inspected by Skay LTD once it has been purchased, before it is shipped. Problems and claims arising after the vehicle has arrived in the client’s port must be made within 14 days after the landing. Clients are advised to make claims through email or fax. Skay LTD will then advice on necessary details and actions that must be taken.

  10. It is the responsibility of the client to know the laws and regulations that apply to the import of a vehicle to their respective countries. Skay LTD can only provide links to information within its website, and is not responsible for giving advice that can be found through research by the client of their respective countries’ governmental website. Skay LTD will, however, provide documentation that is required by the client in compliance with their country’s laws.

  11. Charges incurred after the vehicle’s departure from Japan is the responsibility of the client, including port, storage and other fees that might be incurred.

  12. The following are fees that apply when using our services:

    1. Commisssion
      Skay LTD charges commission when buying vehicles from auctions.
      Before purchase from an auction the following charges apply:

      Charge per vehicle:
      ¥70,000 Yen if the car costs over ¥1,000,000 Yen
      ¥50,000 Yen if the car costs under ¥1,000,000 Yen
      5% of the cost of the vehicle

      If the client has pre-paid for a vehicle (which can be used for the purchase of similar vehicles), the percentage commission will be reduced to 2% per vehicle.

      After a successful purchase from an auction the following must be paid before delivery:

      Full price of the vehicle purchased.

    2. Shipping and Transportation Costs

      Transportation of vehicles within Japan, shipping to other countries, and other costs related to transportation will be paid by the client. Skay LTD perseveres to keep transportation costs inexpensive and quick, but cannot affect events that relate to transportation companies, such as space limitations and transport delays. The client is expected to give up-to-date information about shipping destinations and details, to help allay any delays in the transportation process.

      The client can arrange their own payment to the shipping companies, which is the most common method, so transportation fees paid to Skay LTD will be limited to transportation within Japan. If the client wishes Skay LTD to arrange shipping, the client can also opt for added marine insurance for the transportation of the vehicle, which may be required depending on the circumstances.

      Once shipping charges has been sent to the client, the client is expected to give full payment before the vehicle is shipped. Payment for shipping costs can be made before the exact cost is known, but incurs an extra charge in addition to cover for extra costs that can apply, for example, due to changing exchange rates.


    3. Storage Fees

      Storage fees while the vehicle is waiting to be delivered in Japan will not be paid for the client unless they wish to delay its shipping. A fee will be charged for each day the car is in storage, but Skay LTD may deliver the vehicle for shipping if space limitations require it to be so. Any extra costs and results from the extended storage of a vehicle will be paid for by the client.


    4. Cancellation and Late Payment Penalties

      Skay LTD will charge a cancellation fee if the client wishes to cancel their order, after the vehicle has been purchased and before it is booked to be shipped to their country. The fee is \100,000 plus 20% of the cost of the vehicle. If this fee is not paid within 14 days of informing Skay LTD, the process of delivery will continue and the client is expected to pay the costs related to the purchase of the vehicle. Cancellation cannot be accepted after the booking has occurred.

      Any late payments will incur an interest rate of 10% per annum, and all other current dealings with the client will be suspended. Any charges incurred due to the delay must be paid for by the client. Any problems arising in terms of payment must be communicated to Skay LTD by the client as soon as possible, so that it can be resolved quickly and prevent further problems arising from delays.

      Payment for all vehicles made by the client in accordance to the conditions within this document that the client must agree to before requesting the service of Skay LTD. Payment is paid by Bank Telegraphic Transfer, in Japanese Yen. Skay LTD will give details of bank accounts once payment is required.

  13. Vehicles purchased by the company through the auctions will be the property of the company until full payment for the cost and fees are received, after which the ownership will be transferred.

  14. The following documentation will be available to the client once ownership has been transferred, via insured airmail:

    - An Invoice
    - The Bill of Lading (BL).
    - Registration Cancellation Certificate (the Export Certificate).
    - An English translation of the Registration and Registration Cancellation Certificate if required by the client’s country’s laws
    - Marine Insurance Certificate (if applicable)

    The client is expected to give correct and full details of the address to which the documentation must be sent. Skay LTD will do its best to ensure that the documents are delivered quickly and safely, but cannot be held liable for unforeseen events that might occur during transport.

  15. Skay LTD and the client will abide by these conditions, and any problems arising from these conditions must be stated clearly for quick resolution. Any other problems that are not covered in these conditions will be resolved through negotiation.

    Should negotiation and a mutual understanding fail to be reached, all disputes must be settled under Japanese Law.
